Article 1 - Purpose

The purpose of these terms and conditions of sale are to define the sales of COMPTOIRS ET COMPAGNIES – 9 rue de la Carraire - 13770 Venelles, specialized in the sale of food and cosmetic products to people browsing on the website www.comptoirsetcompagnies.com

Article 2 - Price

The prices of our products are indicated in euros (€) including taxes (VAT and other charges applicable on the day of the order), unless otherwise stated and excluding processing and shipping costs.

Every order have to be paid in euros.

COMPTOIRS ET COMPAGNIES reserves the right to change the price of its products at any time, but the product will be charge based on the current rate at the time of order validation and subject to availability.

The products remain the property of COMPTOIRS ET COMPAGNIES until the complete paiement.

Attention : as soon as you (or a third person designated by you) physically take possession of the ordered products, the risks of loss or damage to the products are transferred to you.

Article 3 - Orders

The contractual information is presented in english and will be confirmed at the latest at the time of validation of your order.

Comptoirs et Compagnies reserves the right to refuse paiement and to not confirm an order in the event of existing disagreement with the customer (in particular in the event of non-payment)

Article 4 - Validation of your order

Every order made on the website www.comptoirsetcompagnies.com involves your full and complete acceptance of these terms and conditions of sale, without any exceptions or reservations.
All the data provided will consitute proof of the transaction.

The order confirmation will servce as a signature and acceptance of the transactions carried out.

A summary of the details of your order and these terms and conditions of sale will be communicated to you by email.

Article 5 - Payment

By confirming your order you accept to pay the indicated price.

Payment for your purchases is made by credit card using the Axepta secure system.

The payment of credit card is debited at the time of payment. In case of split deliveries, only the shipped products are debited.

Every order exceeding 600€ including taxes will be shipped after the effective collection of the due amount.

Article 6 - Withdrawal

In accordance with the article L.222-7 of the Consumer Code, you have a period of 14 days from the receipt of your products to exercice your right of withdrawal neither having to justify nor pay penalty.

The products have to be returned as seen and complete (packaging, accessories, instructions), so the product can be sold again. Any damage to the product may defeat the right of withdrawal. For any return as part as your right of withdrawal, you must send a request by email at contact@comptoirsetcompgnies.com or by post at 9 rue de la Carraire - 13770 - Venelles enclosing the withdrawal form here, duly completed, within 14 days from the date of delivery.
You are responsible for the shipping costs

In the event you use your right of withdrawal, COMPTOIRS ET COMPAGNIES will proceed to the refund of the sums paid, within 14 days following the notification of your request and through the same means of payment used at the time of the order.

Article 7 - Availability

Our products are offered as long as they are visible on the site www.comptoirsetcompagnies.com and within the limits of available stocks.
In the event of unavailability after your order, you will be informed by email. Your order will be automatically cancelled and no bank debit will be made.

In addition, the website www.comptoirsetcompagnies.com is not destined to sell products in large quantities. Therefore, COMPTOIRS ET COMPAGNIES reserves the right to refuse order of 10 identical items.

Article 7 - Delivery

The products are delivered to the provided address at home or at pick up point, within the period indicated on the order validation page.

The products are shipped in mailand France

Shipping time may be extended due to the conditioning of the delivery to the collection of funds for orders over 600 € TTC.

In the event of a shipping delay, a mail will be sent by the transporter.

In accordance with the legal requirements, in the event of shipping delay, you have the possibiliy to cancel the order within the condition of article L 138-2 of the Consumer Code. If you receive the product in the meantime, we will proceed to its refund and shipping cost within the conditions of article L 138-3 of Consumer Code.

COMPTOIRS ET COMPAGNIES can not be responsible for shipping delay due to customer unvailability after several proposal of appointment.

Reason for returns : « NPAI »

The reason for returns « NPAI » correspond to the returned packages by the transporter for the reason « N'habite Pas à l'Adresse Indiquée » which means « wrong address ». After the receipt of the package at COMPTOIRS ET COMPAGNIES, a credit note of the amount of the order, shipping costs deducted, will be credit on the customer's bank account within 48h following the receipt of the package at COMPTOIRS ET COMPAGNIES. The customer will be able to order again, providing a correct delivery address.

Reason for returns : « non claim »

The reason for returns « non claim » correspond to the packages that have not been picked up by the customers at the pick up point within 15 days from the delivery notice. After the receipt of the package at COMPTOIRS ET COMPAGNIES, the amount of the order, shipping costs deducted, wil be credit on the customer's bank account or the customer will be able to chose the return of his/her order and pay shipping costs corresponding to this return.

Article 9 - Guarantee

In the event of non-compliance or defect of the delivered products , you must send a request by mail to contact@comptoirsetcompagnies.com or by post to 9 rue de la Carraire - 13770 - Venelles.

9.1 Legal guarantees

« It is said that the consumer, as part as the legal guarantee of compliance :

- get 2 years from the product delivery to act

- may chose between repair or replacement of the product, subject to the cost of conditions provided in the article L.217-9 of the Consumer Code.

- is exempted from providing for the existance of lack of compliance of the product.

The legal guarantee of compliance provided for in the article L.217-12 of the Consumer Code applies independently of the guarantee relating to defects in the product sold, within conditions provided for in the article 1641 to 1648 and 2232 of the Civil Code. »

Article L217-4 of the Consumer Code :
« the seller is required to deliver a product in compliance with the contract and responsible for any lack of conformity existing at the time of delivery. The seller is also responsible for non-compliance defects resulting from packaging, assembly instructions or installation when they have been put his charge by the contract or have been carried out under his responsibility. »

Article L217-5 of the Consumer Code :
« To be in compliance with the contrat, the product must :

1) be fit for the purpose usually expected of similar goods and, if applicable :

- correspond to the description given by the seller and possess the qualities that the seller has presented to the buyer in the form of a sample or model

- Present the qualities that a buyer can legitimately expect in view of the public statements made by the seller, the producer or his representative, particularly in advertising or labelling.

2) Or present the characteristics defined by mutual agreement between the parties or be suitable for any special use sought by the buyer, brought to the attention of the seller and accepted by the latter. »

Article L217-12 of the Consumer Code :
« The action resulting from the defect of conformity is prescribed by 2 years from the delivery of the good. »

Article L217-16 of te Consumer Code :
« When the buyer asks the seller, during the course of the commercial guarantee which was granted to him at the time of the acquisition or repair of a movable good, for a repair covered by the guarantee, any period of immobilization of at least seven days, comes to be added to the duration of the guarantee which remained to run. This period runs from the date of the purchaser's request for service or from the date the item in question is made available for repair, if the item is made available after the request for service.

Article 1641 of the Civil Code:
« The seller is bound by the warranty for latent defects in the item sold which make it unfit for the purpose for which it was intended, or which reduce that purpose that the buyer would not have acquired it, or would have given only a lesser price, if he had known of them. »

Article 1648 paragraph 1 of the Civil Code :
« The action resulting from redhibitory defects must be brought by the buyer within a period of 2 years from the discovery of the defect. »


9.2 Contractual guarantee in case of non compliance

In the event of lack of conformity of the product, notified within 30 days from the delivery of the product, you can request a refund of the product.

Beyond 30 days, only a replacement (or a repair if the product allows it) within the framework of the legal guarantee of conformity can be granted.

Article 10 - Responsibility

The offered products are in compliance with french legislation in force. The responsibility of the company COMPTOIRS ET COMPAGNIES could not be committed in the event of nonrespect of the legislation of the country where the product is delivered if the delivery is carried out outside France. It is up to you to check with the local authorities the possibilities of importing or using the products or services that you plan to order.

Moreover, the company COMPTOIRS ET COMPAGNIES could not be in charge of the damage resulting from a bad use of the bought product.

Finally, COMPTOIRS ET COMPAGNIES cannot be responsible for any inconvenience or damage inherent to the use of the Internet network, in particular a break in service, an external intrusion or the presence of computer viruses.

Article 11 - Applicable law in the event of disputes

The language of this contract is French. These terms and conditions of sale are subject to French law. In the event of disputes, French courts will will have exclusive jurisdiction.

Article 12 - Intellectual property

The content of the website www.comptoirsetcompagnies.com are and remain the intellectual and exclusive property of the company COMPTOIRS ET COMPAGNIES. No one is authorized to reproduce, use, rebroadcast, or use for any purpose, even partially, elements of the site whether they are softwares, visuals or sounds. Any simple link or hypertext link is strictly forbidden without the express written agreement of the company COMPTOIRS ET COMPAGNIES.

Article 13 - Archiving Evidence

The society COMPTOIRS ET COMPAGNIES will archive orders and invoices on reliable and lasting support establishing a carbon copy in accordance with the article 1379 of the Civil Code.

The computerized registers of the company COMPTOIRS ET COMPAGNIES will be considered by all the concerned parties as proof of the communications, orders, payments and transactions occurred between the parties.

Article 14 - Mediation of consumer disputes.

In accordance with the provisions of the Consumer Code concerning the amicable settlement of disputes, COMPTOIRS ET COMPAGNIES is a member of the Association of European Mediators (electronic commerce) whose contact details are as follows Médiation de la consommation AME, 11 Place Dauphine, 75001 Paris, www.mediationconso-ame.com.

You can use the mediation service for consumer disputes related to an order placed with COMPTOIRS ET COMPAGNIES on the Internet. Conformément aux règles applicables à la médiation, tout litige de consommation doit être confié préalablement par écrit au Service Consommateur de COMPTOIRS ET COMPAGNIES – 9 rue de la Carraire - 13770 - Venelles.

After prior written request from the consumer to COMPTOIRS ET COMPAGNIES, the mediator may be contacted for any consumer dispute which has not been settled.
